In the server rules, you can only do so if your friend agrees. Also, you must return their stuff peacefully.

What if somebody harasses me and gangs up around the spawn nether portal for cheap kills, but doesnt get caught and i lose all my stuff? Will you refund? How will u catch them?

That's considered griefing, so they'll be dealt with accordingly, and your stuff will be returned. It's impossible for them not to get caught as long as it is reported.
